LEGISLAÇÃO, VALORES SOCIETAIS E ESTUPRO DE VULNERÁVEL: UM ESTUDO DAS PERCEPÇÕES E VALORES DE 319 ADULTOS NA REGIÃO METROPOLITANA DO RECIFE

Resumo

No Brasil, o sexo com menores de 14 anos (Estupro de Vulnerável) é um delito fortemente subnotificado, havendo pouca informação confiável acerca do assunto. A compreensão desse tema passa pelos condicionantes socioculturais do crime, com destaque para o modelo de Harper (2011) no caso do estupro de vulneráveis. O presente trabalho buscou investigar as percepções e julgamentos de 319 adultos da Região Metropolitana do Recife quanto à atividade sexual de adolescentes e ao sexo entre adultos e adolescentes. Os resultados apontaram que os pesquisados mostraram: (A) perceber grande atividade sexual adolescente, (B) ter grande desconhecimento da lei, (C) condenar veementemente o crime, (D) considerar o sexo e o grau de maturação biológica da vítima, bem como a diferença etária entre a vítima e o autor, e (E) diferenciar substancialmente rapazes e moças. Esses achados sugerem que: (I) há espaço para um debate social acerca do atual ordenamento jurídico, (II) há um argumento a favor de magistrados usarem elementos não previstos explicitamente em lei ao realizarem a dosimetria penal, e (III) o modelo sociocultural de Harper apresenta potencial para se lidar com o tema no Brasil. Ao final, são recomendados estudos futuros sobre o tema.

Legislation, Societal Values and Statutory Rape: A Study of the Perceptions and Values of 319 Adults in the Metropolitan Region of Recife

 

Abstract: In Brazil, sex with a 14 year-old minor or younger (Statutory Rape) is a largely underreported felony, there being very little reliable information on the subject. The understanding of this issue involves the sociocultural elements that condition crime, with a highlight for the model from Harper (2011) in the case of statutory rape. The present work sought to investigate the perceptions and judgements of 319 adults from the Metropolitan Region of Recife as to the sexual activity of adolescents and sex between adults and adolescents. The results indicated that the individuals surveyed showed: (A) the perception of a great deal of adolescent sexual activity, (B) a significant lack of knowledge regarding the law, (C) strong condemnation of the crime, (D) consider the sex and biological maturation of the victim, as well as the age difference between author and victim, and (E) differentiate substantially between boys and girls. Such findings suggest that: (I) there is room for a social debate regarding the current legal ordainment, (II) there is an argument for magistrates to use elements that are not explicit in the law in their penal dosimetry, and (III) the sociocultural model from Harper presents the potential for dealing with the problem in Brazil. In the end, future studies on the topic are recommended.
